Years ago I did a job and the customers kids knocked the air cond condensate line out of his utility sink…I got the call and went over to the job..it had been leaking for awhile and the guy refused to let me come in and fix it..I asked if he was running the ac and he said yep! ..I said why would you do that ? Your causing a flood.?..he said I want to let insurance look at it…I said yeah ok but you can’t knowingly flood your basement and make the problem worse because you want all new carpet..I was a subcontractor for a national company at the time and I told them I WILL go to court on this one before I ever give them a dime.

They must have told him to go pound sand because I never heard anything about it again

Jasin, by now you've learned on this forum, other forums and life experiences that some people have a strange idea of what insurance will pay and what they refuse: The old story of "If you knew you were speeding, were drunk, or had a headlight out (I could go on and on) they will refuse the claim." Utter nonsense.

I know..I agree insurance will pay most of the time …but if your house has smoke coming out of it and you prevent the fire dept from getting to it to put it out..then I doubt insurance would pay..lol
That was my point with the water flooding in the house I was working on

I might have just misunderstood you ..if I did my apologies and carry on my friend

Is this common in Idaho to be 'sited and released' for DWI? Like here's your summons for illegal left turn, now be off with you...

Unfortunatly these days most likely. Depends on the DA's office, if it's a "no bail" state, etc. In most other countries (especially European) this would result in some serious monetary and encarceration penalties. Nowadays DUI is likely one of the lesser offences that's treated like a "same day dry cleaning service".

If he was drunk, release him to get back in the truck (or another vehicle) and continue to drive drunk ??? Maybe there were "no injuries" this time he ran into a building, but what about in 10 minutes??? Won't he still be drunk ???

To John's point, the vast majority of drivers that kill with a vehichle while under the influance are multiple DUI offenders.

Yeah but incarceration would kill the "buzz" wouldn't it? Any more that seems to be a no no in many jurisdictions and certainly wouldn't work in the "catch and release" locations that seem to be proliferating......

Or, since we're "postulating"... The cop gives the drunk a ticket, tells him not to drive, so he stumbles out into traffic and gets run over by someone towing a fifth wheel with an overloaded F150 that simply couldn't stop in time... The drunk's family sues the police department for not "protecting an incapacated person" and includes the F150 driver in the suit. The F150 driver counters with, "I wouldn't have run over him if the cop would have arrested him, so my being overloaded is not the reason for the accident"....

Just can't win for losing, eh ???

Russ, being drunk, driving into the front of a business and then sited and released? Really? Not in Tennessee. DWI's are kept until sober. They're still stupid, but sober.
Honestly, I was under the impression that Oregon had a mandatory first DUI 48 hours in the jug. Huh...they just give you a ticket and send you on your way drunk. I'll be dipped.

I was assuming that the driver would be released to the custody of a sober person.
