The brass fitting will be the check valve. With a one handle bypass valve (vs 3) the bypass valve diverts the water from the inlet to the water heater. Once it is turned and bypassing the cold inlet it depends on the check valve to keep the diverted water from running into the hwh from the hot side. If your hwh keeps filling whether the valve is in bypass or not it sounds like the check valve has failed. Pull it out and they sell them at Lowe's, Home Depot etc.
